By using the TAYO Literary Magazine’s Web Site (“this site,” as in tayoliterarymag.com), you are agreeing to be bound by the following terms and conditions (“Terms of Use”). TAYO Literary Magazine may modify this Agreement from time to time and such modification shall be effective upon posting on TAYO’s Website. Your continuing use of Tayoliterarymag.com after a revision in the Terms of Use signifies your acceptance of the revised Terms of Use. TAYO Literary Magazine will do its best to ensure that its members receives notice to any changes to the Terms of Use, but reserve the right to change the Terms of Use at anytime with or without notice.

Registration

You must be 13 years of age or older in order to use this site. You must confirm that you are 13 years old or older during the registration process in order to use our site.

Editorial Content Terms of Use
TAYO typically display images, audio, and video (the “Material”) as part of blog posts. The types of Material editors may use include:

  • Materials taken and created by TAYO
  • Materials submitted by contributors (those who submit their works to TAYO), with the implied representation that the person submitting the material owns the copyright in the material and the right to give it to us, such proof will be written in the TAYO Submission and Release Form  (also refer to TAYO Contributor Material Terms)
  • Material released into the public domain by public relations and marketing companies for press purposes
  • Material covered by the Fair Use Doctrine, taking into account factors such as:
    1. The purpose and character of the use
    2. The nature of the copyrighted work
    3. The amount and substantiality of the portion used in relation to the whole
    4. The effect of the use on the potential market value for the copyrighted work

If TAYO receives notice that Material posted by editorial (and any user generated materials) is not in keeping with these terms and conditions, we reserve the right to remove such materials at anytime with or without notice.

If you think we have published Material that infringes your copyright, we will address your concerns.

To file a notice of infringement with us, you must provide a written communication (by email with an attached and signed PDF) that includes the items listed below.
To enable us to address your concerns, please provide the following information:

  1. For each allegedly infringing image, video or piece of text that you wish to have removed, provide the exact permanent URL for the page containing the material.
  2. Provide information for us to contact you: an email address is preferred.
  3. Information detailing your claim to ownership of the copyright in the allegedly infringing image.
  4. Include the following statement: “I swear, under penalty of perjury, that the information in the notification is accurate and that I am the copyright owner or am authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.”
  5. Sign the document and email it to: tayoliterarymag@gmail.com.

TAYO Contributor Materials Terms

TAYO Contributors refer any contributions in the form of images, videos, writing, comments, articles, store information, tags, addresses, user information, and any other form of materials submitted to Tayoliterarymag.com through its print publication and online contribution pages, email, contacts or any other form of communication channels.

With respect to any worldwide copyrights, or copyright applications and registrations, in your contribution:

  • you hereby assign to us ownership, and to the extent that such assignment is or becomes invalid, ineffective or unenforceable, you hereby grant to us a perpetual, irrevocable, non-exclusive, worldwide, no-charge, royalty-free, unrestricted license to exercise all rights under those copyrights. This includes, at our option, the right to sublicense these same rights to third parties through multiple levels of sublicensees or other licensing arrangements;
  • you agree that each of us can do all things in relation to your contribution as if each of us were the sole owners, and if one of us makes a derivative work of your contribution, the one who makes the derivative work (or has it made) will be the sole owner of that derivative work;
  • you agree that you will not assert any moral rights in your contribution against us, our licensees or transferees;
  • you agree that we may register a copyright in your contribution and exercise all ownership rights associated with it; and
  • you agree that neither of us has any duty to consult with, obtain the consent of, pay or render an accounting to the other for any use or distribution of your contribution.

With respect to any patents or copyrights you own, or that you can license without payment to any third party, you hereby grant to us a perpetual, irrevocable, non-exclusive, worldwide, no-charge, royalty-free license to:

  • make, have made, use, sell, offer to sell, import, and otherwise transfer your contribution in whole or in part, alone or in combination with or included in any product, work or materials arising out of the project to which your contribution was submitted, and
  • at our option, to sublicense these same rights to third parties through multiple levels of sublicensees or other licensing arrangements.

Except as set out above, you keep all right, title, and interest in your contribution. The rights that you grant to us under these terms are effective on the date you first submitted a contribution to us.

With respect to your contribution, you represent that:

  • it is an original work and that you can legally grant the rights set out in these terms;
  • it does not to the best of your knowledge violate any third party’s copyrights, trademarks, patents, or other intellectual property rights

Comments Terms of Use

  • Do not post threatening, harassing, defamatory, or libelous material.
  • Do not post material that infringes copyright.
  • Keep all comments relevant.
  • TAYO will not accept responsibility for information posted in the Comments, and will reserve the right to remove any comment at anytime with or without reason.

These terms will be governed by the laws of the State of California and applicable U.S. Federal law. Any choice of law rules will not apply.
